Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Chairlift app and website ("Service") operated by La Superica SARL.

1. Acceptance of Terms

By accessing or using Chairlift, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 16 years old to use Chairlift. By using the Service, you confirm that you meet this age requirement.

3. Personal Use Only

Chairlift is for individual, personal use only. Commercial use is not permitted.

4. User Accounts

Users may sign up via Google, Facebook, or Apple login. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Data and Privacy

Your data is collected and managed in accordance with our Privacy Policy. Public information includes your travel dates, location, and profile if you've joined a chairlift or club.

6. User Conduct

You agree not to:

• Post content containing nudity, hate speech, or any offensive material.
• Harass, threaten, or harm other users.
• Impersonate another person or entity.

We reserve the right to moderate, remove, or ban any user or content that violates these standards.

7. User-Generated Content and Communication

Users can create or join Chairlifts (groups for ski/snowboard meetups), clubs, and in the future, "Aprés" events. Communication between users is available within each Chairlift group.

La Superica SARL is not responsible for any in-person meetups or interactions that occur as a result of using the Service.

8. Subscriptions and Payments

Chairlift is currently free. In the future, we may offer premium features through paid subscriptions. Any such features will be clearly described, and payment terms will be provided before purchase.

9. Professional Chairlifts - Liability Waiver and Assumption of Risk

IMPORTANT: Professional Chairlifts are paid experiences provided by independent professional instructors, guides, or athletes ("Professionals"). By participating in a Professional Chairlift, you acknowledge and agree to the following:

9.1 Assumption of Risk

You understand and acknowledge that skiing, snowboarding, and all mountain sports involve inherent risks and dangers including, but not limited to:

• Serious injury, paralysis, or death
• Collisions with other persons, objects, or terrain features
• Avalanches, changing weather conditions, and extreme cold
• Equipment failure or malfunction
• Variations in terrain, surface conditions, and visibility
• Your own physical condition, ability level, and actions

You voluntarily assume all risks associated with participation in Professional Chairlifts, whether known or unknown, and whether foreseen or unforeseen.

9.2 Release of Liability

You hereby release, waive, discharge, and covenant not to sue:

• La Superica SARL (Chairlift platform operator)
• The Professional providing the service
• Ski resorts, lift operators, and property owners where activities take place
• Their respective officers, employees, agents, and affiliates

From any and all liability, claims, demands, actions, or causes of action arising from or related to any loss, damage, injury, or death that may be sustained by you or any property belonging to you, whether caused by negligence or otherwise, while participating in Professional Chairlift activities.

9.3 Independent Service Providers

Professionals offering services through Chairlift are independent contractors, NOT employees or agents of La Superica SARL. Chairlift acts solely as a platform connecting users with Professionals. We do not:

• Employ, supervise, direct, or control Professionals
• Verify professional qualifications, certifications, or insurance
• Guarantee the quality, safety, or legality of Professional services
• Assume any responsibility for Professional conduct or services provided

9.4 Medical Fitness and Insurance

You certify that you are physically fit and have no medical conditions that would prevent safe participation. You are responsible for:

• Obtaining adequate health, accident, and liability insurance
• All medical expenses resulting from injury or illness
• Consulting your physician before participating if you have any health concerns

9.5 Equipment and Safety

You are responsible for:

• Wearing appropriate safety equipment (helmets, protective gear, etc.)
• Ensuring your equipment is properly fitted and in good working condition
• Following all safety instructions provided by the Professional
• Skiing/riding within your ability level and in control at all times

9.6 Indemnification

You agree to indemnify, defend, and hold harmless La Superica SARL, the Professional, and all related parties from any claims, liabilities, damages, or expenses (including legal fees) arising from your participation in Professional Chairlift activities.

9.7 Acknowledgment

BY JOINING A PROFESSIONAL CHAIRLIFT, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS WAIVER, UNDERSTAND ITS CONTENTS, AND AGREE TO BE BOUND BY ITS TERMS. THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN YOU AND CHAIRLIFT/LA SUPERICA SARL.

10. Termination

We may suspend or terminate your account without notice if you violate these Terms or misuse the Service.

11. Limitation of Liability

Chairlift is provided "as is" and "as available." We do not guarantee uninterrupted or secure access to the platform. In no event shall La Superica SARL be liable for any damages resulting from your use of the app, including but not limited to any in-person meetings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes through the app or email. Continued use after changes are posted constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of France. Any disputes arising from or relating to the Service shall be resolved in the courts of France.
